Welcome to the website of Zomerlust, operated by ION Paarl (Pty) Ltd (“Zomerlust”, “we”, “our”, or “us”).
By accessing or using this website, making a reservation, dining at our restaurant, or communicating with us through the website or third-party platforms, you agree to be bound by these Terms & Conditions.
If you do not agree to these Terms, please refrain from using this website or making use of our services.

3. Eligibility to Book
By making a reservation through this website or any third-party booking platform, you confirm that:
You are at least 18 years old; and
You are legally authorised to enter into binding agreements.
4. Website Use
You agree to use this website only for lawful purposes.
You may not:
use the website fraudulently or unlawfully;
attempt to gain unauthorised access to systems or data;
interfere with website functionality;
introduce malicious software;
copy or reproduce website content without permission.
We reserve the right to restrict or terminate access where misuse is suspected.
5. Reservations & Bookings
All reservations are subject to availability and written confirmation.
Reservations may be made:
directly through Zomerlust;
through third-party accommodation booking platforms;
through restaurant reservation platforms;
or through authorised travel agents.
Special requests are not guaranteed but will be accommodated where reasonably possible.
6. Deposits & Payment Terms
A reservation is only confirmed once the required deposit has been received.
Standard booking terms are:
50% of the total accommodation amount is payable at least 30 days prior to arrival;
full outstanding balance payable on check-in unless otherwise agreed in writing.
Different payment terms may apply to:
group bookings;
special events;
promotional offers;
or third-party booking platforms.
All deposits and cancellation charges are subject to the Consumer Protection Act 68 of 2008 and must be reasonable in the circumstances.
Payments may be processed through secure third-party payment providers.
7. Cancellation Policy
Cancellation requests must be submitted in writing.
Unless otherwise stated in writing or through a third-party booking platform, the following cancellation terms apply:
30+ days prior to arrival: 10% of the total accommodation payable
Less than 30 days and more than 14 days prior to arrival: 25% payable
Less than 14 days and more than 7 days prior to arrival: 50% payable
Less than 7 days prior to arrival: 100% payable
Non-arrival (“no-show”): 100% payable
Refunds, where applicable, will be processed in accordance with the Consumer Protection Act and may take into account:
the ability to resell the accommodation;
operational costs incurred;
and the reasonableness of cancellation charges.
Different cancellation policies may apply to group bookings, events, restaurant reservations, or third-party booking platforms.
8. Check-In & Check-Out
Standard check-in time: 14h00
Standard check-out time: 10h30
Early check-in and late check-out are subject to availability and may incur additional charges.
Guests may be required to present valid identification upon check-in.
9. Restaurant Reservations
Zomerlust operates an in-house restaurant and may accept restaurant reservations through:
direct bookings;
reception;
telephone;
WhatsApp;
or third-party reservation systems such as Dineplan.
Restaurant bookings are subject to availability and operational requirements.
Special dietary requirements or allergies should be communicated in advance.
10. Guest Conduct
Guests are expected to behave respectfully toward staff, other guests, and the property.
Zomerlust reserves the right to refuse accommodation or service, or remove guests from the property without refund where conduct is:
abusive;
disruptive;
unsafe;
illegal;
threatening;
or damaging to the property or reputation of the establishment.
11. Smoking Policy
Smoking is strictly prohibited:
inside the hotel;
on verandas;
and within restaurant areas.
Additional cleaning, repair, or recovery costs resulting from smoking violations may be charged to the guest account.
12. Damages & Incidentals
Guests are responsible for any intentional or negligent damage, breakage, loss, excessive cleaning, or operational loss caused by themselves, their visitors, or invited guests during their stay.
Zomerlust reserves the right to recover reasonable associated costs, including, where applicable, loss of income.
13. Liability Disclaimer
Guests enter and use the premises, including gardens, parking areas, accommodation facilities, restaurant facilities, and common areas at their own risk.
To the fullest extent permitted by law, Zomerlust and ION Paarl (Pty) Ltd shall not be liable for:
theft, loss, or damage to personal property;
injury, illness, or accidents;
indirect or consequential damages;
travel disruptions;
technical website issues;
third-party service interruptions.
Safes are provided in rooms where applicable, and guests are encouraged to secure valuables appropriately.
Nothing in these Terms excludes liability where exclusion is not permitted by law.
14. Third-Party Platforms & Services
Zomerlust may make use of:
accommodation booking platforms;
restaurant reservation systems;
payment gateways;
marketing service providers;
analytics tools;
outsourced website providers;
and cloud-based hospitality software.
Use of such services may be subject to third-party terms and privacy policies.
15. Intellectual Property
All website content, including text, photography, branding, graphics, logos, and design elements, is the property of Zomerlust or its licensors and may not be reproduced without written permission.
16. Privacy & POPIA
Your use of this website and our services is also governed by:
our Privacy Policy; and
our POPIA Compliance Policy.
17. Force Majeure
Zomerlust shall not be liable for any failure or delay in performing obligations where such failure or delay results from circumstances beyond reasonable control, including but not limited to:
natural disasters;
severe weather;
fire;
pandemics;
government restrictions;
power failures;
labour disputes;
civil unrest;
interruption of utilities or services;
or any event beyond reasonable operational control.
In such circumstances, Zomerlust reserves the right to amend, cancel, postpone, or reasonably modify reservations where necessary.
18. Children
Parents and guardians remain fully responsible for supervising children at all times while on the property, including within:
accommodation areas;
gardens;
parking areas;
restaurant spaces;
and any public or recreational areas.
Zomerlust accepts no responsibility for injuries or incidents arising from inadequate supervision.
19. Property Features & Accessibility
As a heritage property, Zomerlust may contain:
stairs;
uneven surfaces;
heritage architectural features;
garden pathways;
or other areas that may not be fully accessible or suitable for all mobility requirements.
Guests requiring accessibility information are encouraged to contact us prior to arrival.
20. Utilities & Service Interruptions
While reasonable efforts are made to maintain uninterrupted services, Zomerlust shall not be liable for interruptions relating to:
electricity supply;
loadshedding;
water supply;
internet services;
municipal service interruptions;
telecommunications;
or utility failures beyond reasonable control.
21. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the South African courts.
22. Amendments
Zomerlust reserves the right to update these Terms & Conditions at any time.
